By accessing our website, booking an assessment, submitting information to us, or purchasing or using any of our services, you agree to these Terms of Service.
If you do not agree with these Terms, please do not use our website or engage our services.
Where you enter into a separate written service agreement, quotation, mandate, or other agreement with Betafin, that document will apply together with these Terms. If there is a direct conflict, the specific written agreement will take precedence to the extent of that conflict.
Depending on the service you select and your circumstances, Betafin may provide services including:
Our services are limited to the scope agreed with you. We do not promise that every item on a credit profile can be removed, corrected, suppressed, or changed.
Credit repair is not a guaranteed-outcome service. A dispute may be accepted, rejected, partially accepted, referred for further investigation, or otherwise determined by the relevant credit bureau or information provider.
We cannot guarantee:
We will not knowingly make a false or misleading representation about your credit profile or submit information that we know to be false.
You agree to provide information and documents that are accurate, complete, current, and reasonably necessary for us to perform the services.
Depending on your case, this may include a certified copy of your ID or passport, proof of address, credit reports, supporting documents, account information, court documents, debt-review documentation, or other evidence relevant to a dispute.
You are responsible for ensuring that documents supplied to us are genuine and belong to you. If information is incomplete, inaccurate, illegible, or not supplied when required, this may delay or prevent us from performing the service.
Where our service requires us to communicate with a credit bureau or another party on your behalf, you authorise us to do so only to the extent reasonably necessary to perform the agreed service.
You may be required to sign a mandate, consent, authority, or other supporting document before we can act on your behalf.
You remain responsible for the truthfulness of information supplied to us and for responding to reasonable requests for clarification or additional evidence.
Where appropriate, we may work with or communicate with credit bureaus including TransUnion, Experian, Compuscan, and/or XDS.
Credit bureaus and data providers are independent third parties. Their internal processes, investigation times, decisions, record-keeping, and systems are outside Betafin's control.
We may request that inaccurate or disputable information be investigated or corrected, but the final determination rests with the relevant credit bureau, information provider, creditor, court, or other competent authority.
Our fees are communicated to you before you commit to a paid service, whether through a quotation, service agreement, invoice, checkout page, or other written communication.
Unless expressly stated otherwise in writing, payment for a service does not constitute a guarantee that a particular credit-profile entry will be removed or that your credit score will increase.
Cancellation and refund rights depend on the service purchased, the stage at which work has commenced, and applicable South African consumer-protection law.
If you wish to cancel a service or request a refund, contact us as soon as possible at [email protected]. We will assess the request against the applicable agreement, our refund policy, and applicable law.
Where work has already been performed, we may be entitled to retain an amount reasonably attributable to services already delivered, subject to applicable law.
Our work may depend on third parties, including credit bureaus, creditors, attorneys, debt counsellors, payment processors, technology providers, hosting providers, and communication or scheduling platforms.
We are not responsible for delays, outages, decisions, errors, or failures caused by a third party where the matter is outside our reasonable control. We will, however, take reasonable steps to communicate material issues that affect your case.
Betafin is not a registered debt counsellor and our services do not constitute debt counselling unless expressly stated otherwise in a separate agreement and lawfully provided by an appropriately authorised person.
We do not provide debt counselling, negotiate debt settlements, restructure your debt, or act as your debt counsellor merely because we assist with your credit profile.
Where your circumstances require debt counselling or another regulated financial service, we may recommend that you obtain advice from an appropriately registered or authorised professional.
To enable us to perform the service effectively, you agree to:
You may use our website only for lawful purposes and in a manner that does not interfere with the operation or security of the website.
You must not attempt to gain unauthorised access to our systems, introduce malicious code, scrape or misuse website content, impersonate another person, or use our website to commit fraud or any other unlawful activity.
We aim to keep website information accurate and current, but we do not warrant that the website will always be available, error-free, complete, or uninterrupted.
Unless otherwise stated, the website, branding, text, graphics, layouts, documents, processes, and other materials made available by Betafin are owned by or licensed to Betafin and are protected by applicable intellectual-property laws.
You may use materials supplied specifically to you for the purpose for which they were provided. You may not reproduce, distribute, modify, resell, or commercially exploit our materials without our prior written permission, except where permitted by law.
Our handling of personal information is governed by our Privacy Policy, which explains what information we collect, why we collect it, how it is used and shared, and the rights available to you under the Protection of Personal Information Act, 2013 (POPIA).
Because credit-profile work involves identity and financial information, you should only submit documents through channels or systems that Betafin has instructed you to use.
We will perform our services with reasonable care and skill. However, to the maximum extent permitted by applicable law, Betafin will not be liable for loss caused by matters outside our reasonable control, including decisions or actions of credit bureaus, creditors, courts, regulators, debt counsellors, or other third parties.
Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited under South African law.
Nothing in these Terms is intended to exclude liability for fraud, wilful misconduct, or any other liability that the law does not permit us to exclude.
To the extent permitted by law, you agree to indemnify Betafin against reasonable losses, claims, costs, or expenses arising directly from your unlawful conduct, fraudulent conduct, deliberate submission of false information, or material breach of these Terms.
This clause does not limit any rights you have under applicable consumer-protection law.
Either party may terminate an ongoing service relationship where permitted by the applicable agreement and law.
We may suspend or terminate services where you provide fraudulent or materially misleading information, instruct us to act unlawfully, repeatedly fail to provide required information, fail to pay amounts properly due, or otherwise materially breach these Terms.
Termination does not automatically cancel obligations that accrued before termination, including payment obligations or obligations that are intended to survive termination.
If you have a complaint about our services, please contact us first so that we have a reasonable opportunity to investigate and resolve the issue.
Please provide your name, contact details, relevant case or reference information, and a clear description of the complaint. We will acknowledge and handle complaints within a reasonable period, subject to the nature and complexity of the matter.
Nothing in this clause prevents you from exercising any statutory right or lodging a complaint with a competent regulator or authority.
These Terms are governed by the laws of the Republic of South Africa.
Subject to any mandatory rights you have under applicable law, disputes relating to these Terms or our services will be dealt with by a competent South African court with jurisdiction over the matter.
We may update these Terms from time to time to reflect changes to our services, business practices, technology, or applicable law. The updated version will be published on this page with a revised "Last updated" date.
Where a change materially affects an existing client relationship, we will take reasonable steps to communicate the change where required.
